DRC works with corporate clients on matters involving Sherman Act Section 1 price-fixing claims, Sherman Act Section 2 monopolization claims, and other alleged antitrust violations. Based on our extensive experience, DRC understands the particular challenges of antitrust litigation, including how to explain the balancing of anti-competitive harms and pro-competitive benefits to jurors.
Recently, DRC assisted with an antitrust class action litigation. A group of supermarket plaintiffs alleged that our client and other egg producers conspired to reduce the supply of eggs to affect the market price for egg products in violation of Section 1 of the Sherman Antitrust Act. For that matter, DRC conducted several multi-day focus groups to present the parties’ arguments, including expert witness testimony, to four nine-person deliberation groups. DRC’s analysis of the focus group presentations included proposed demonstratives that counsel was able to utilize in an upcoming mediation.
